You understand and agree that your use of this Site is at your sole risk. The Site is provided on an “as is” basis. Compass and its subsidiaries, affiliates, officers, employees, agents, partners and licensors expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Compass and its subsidiaries, affiliates, officers, employees, agents, partners and licensors make no warranty that (1) the Site or any other Compass services will meet your requirements; (2) the Site will be uninterrupted, timely, secure or error-free; (3) the results that may be obtained from the use of the Site will be accurate or reliable; (4) the quality of any products, services, referrals, information or other material obtained by you through the Site will meet your expectations; and (5) any errors in the software, hosting platform, or any other connectivity will be corrected. Any material downloaded or otherwise obtained through the use of the Site is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
No advice or information, whether oral or written, obtained by you from Compass through or from the Site shall create any warranty not expressly stated in the Terms.
Notwithstanding certain relevant obligations under the UK Data Protection Act, Compass assumes no responsibility for the timeliness, deletion, mis-delivery, or failure to store any user data. Events beyond our control may also prevent us from being able to deliver information and services on the Site, such as, but not limited to web hosting problems, weather, or other force majeure-type acts beyond our control.
This website is hosted by an external provider. When you register as a new client or post a comment on the Site, you acknowledge that you will be sending data transmissions through Compass computer networks located in the UK and, in some instances, portions of which may be located abroad.
No information contained within the site is intended to act in place of legal or financial advice, and you acknowledge that the information contained on the site should not be used in place of a qualified legal or financial professional.

Under no circumstances will Compass be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use or interpretation of any content posted, emailed, transmitted or otherwise made available through the Site. Compass makes no guarantee regarding the reliability, accuracy or quality of any content or third party information or referrals.
This site is authorised and operated by Compass and you agree not to copy, modify, sell, distribute, or create derivative works based on the Site, in whole or in part.
You agree to indemnify and hold Compass and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from (1) any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through the Site; and (2) your violation of the Terms, your violation of the rights of another, or your reliance upon information provided on the Site which results in the third party claim against you.
Limitation of liability
You expressly understand and agree that Compass and its subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, or consequential damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Compass has been advised of the possibility of such damages), resulting from: (1) the use or the inability to use the Site; (2) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Site; (3) unauthorised access to or alteration of your transmissions or data; (4) statements or conduct of any third party on the Site; or (5) any other matter relating to the Site.

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.

CANCELLATION AND REFUND POLICY
We recognise how busy our clients are and that sometimes problems occur causing our clients to be late for a session. We value our client relationships and will do everything we can to accommodate a change of date, although this is sometimes not possible due to availability of mediators, consultants and/or meeting facilities. However, it can be very problematic when clients fail to turn up for appointments or cancel the same day, or on very little notice. This means those appointments cannot then be offered to other clients.
Our consultants and mediators run a fixed schedule specifically to try to accommodate the lifestyle needs of our clients. Many are booking sessions a month ahead and meeting rooms may have been booked and meeting room leases will be payable whether or not you turn up.
When appointments are cancelled at short notice (these being less than two (2) days ahead of the appointment) a cancellation charge of £50 + VAT will be applied and invoiced. In the event of a second cancellation, we will charge a non-refundable deposit of £100 + VAT when rebooking. This is then set off against the cost of future mediation sessions and deducted from the last bill, so it costs nothing if you do not cancel again. We have discretion to waive cancellation charges in exceptional cases.
The cost to us of a lost booking is well over £100. The cost to our other clients who are waiting for appointments is even higher. We are always acting in the fair interests to all of our clients, however, we reserve the right to stop the mediation relationship with a client if cancellations continue.
COMPLAINTS HANDLING POLICY
If you have any complaint about Compass, the conduct of Kelli Wilks or any Affiliate Mediator, relating to a mediation in which you are or were involved, please let us know about it as soon as possible, either verbally or in writing. We will make contact with you and endeavour to resolve the matter as soon as is practicable. Where appropriate, we may suggest meeting in person for that purpose. If your complaint cannot be resolved to our mutual satisfaction by discussion, with or without a meeting, or if we feel it is inappropriate to attempt to deal with it that way, what happens next will generally be as follows:
As soon as practicable, and certainly within seven (7) calendar days of becoming aware of it, we will acknowledge your complaint in writing and, where appropriate, we may ask you to provide details of it in writing.
On receipt of sufficient written details of the complaint, we will acknowledge receipt in writing and confirm when you can expect to receive a full written response. We will normally respond fully within 14 calendar days, but it may take longer, depending on:
i. how much time it will take to investigate your complaint and prepare a response;
ii. whether we will need to speak to, or obtain information from any other person; and
iii. other pressing work priorities, and the holiday commitments of Kelli Wilks, any Affiliate Mediator, and any others concerned.
Our full written response will typically include a proposal for resolving the matter.
If you are still not satisfied, you may refer the matter to the Civil Mediation Council (CMC) for resolution. Compass reserves the right to adapt the process in a particular case, having regard to (1) the nature and seriousness of the complaint; (2) the nature, background to and history of the matters(s) from which it has arisen; and (3) any other relevant circumstances.
